These Terms explain how Mesh & Myth works with visitors, prospects, and clients across brand identity, website design and development, managed digital infrastructure, and related services. Good work needs clear expectations before it begins.

Great work starts with alignment.

By using our website, requesting a quote, approving a proposal, paying an invoice, or using our services, you agree to these Terms. If a signed agreement says something different, the signed agreement controls.

1. Acceptance of these Terms

These Terms and Conditions govern your access to and use of the Mesh & Myth website, resources, forms, communications, proposals, projects, subscriptions, retainers, and services.

By using our website, submitting a form, requesting a quote, approving a proposal, signing an agreement, paying an invoice, or using our services, you confirm that you have read, understood, and agree to these Terms.

If there is a conflict between these Terms and a separately signed written agreement, statement of work, or proposal approved by both parties, the signed or approved project document will control for that specific engagement.

2. Our services

Mesh & Myth provides brand, creative, website, digital experience, and managed digital infrastructure services. Services may include logo design, brand identity development, brand strategy, website design and development, frontend development, CMS setup, SEO foundations, third-party integrations, content support, domain and hosting support, corporate email configuration, infrastructure management, reporting, and related services.

✓ Services are provided according to the scope, deliverables, timelines, pricing, and terms stated in the relevant proposal, quotation, invoice, agreement, or statement of work.
✓ Mesh & Myth may recommend tools, platforms, technologies, or workflows based on the project requirements and business context.
✓ We do not provide legal, financial, accounting, tax, regulatory, cybersecurity, backend development, API development, database management, or e-commerce operations services unless expressly agreed in writing.

3. Quotes, proposals, and project approval

Quotes and proposals are based on the information available at the time they are prepared. A project begins only after the required approval, payment, onboarding, and/or written confirmation has been completed.

✓ Quotes may expire if not accepted within the validity period stated in the proposal or invoice.
✓ Any work outside the approved scope may require additional fees and a revised timeline.
✓ Project approval may be confirmed by written acceptance, signed agreement, email confirmation, payment of an invoice, or other mutually accepted method.
✓ Mesh & Myth may decline or discontinue a project if the requested work is outside our service scope, conflicts with our policies, or presents operational, reputational, or legal concerns.

4. Client responsibilities

A successful project requires timely communication, accurate information, and clear approvals from the client. You agree to provide the materials, access, feedback, decisions, and information reasonably required for us to perform the services.

✓ Provide accurate business, brand, technical, billing, and contact information.
✓ Provide content, images, credentials, brand assets, domain access, hosting access, platform access, and approvals when required.
✓ Ensure that any materials provided by you do not infringe third-party rights and are lawful for use.
✓ Review deliverables carefully and provide consolidated feedback within the requested review period.
✓ Maintain backups of any materials or information you provide to us.
✓ Designate a primary decision-maker for approvals and project communication.

5. Scope, revisions, and approvals

The scope of each project is defined by the relevant proposal, quotation, package, agreement, or statement of work. Revisions are included only to the extent stated in the approved scope.

✓ Revision rounds must be used to refine the approved direction, not to restart the project or request an entirely new concept unless separately agreed.
✓ Additional concepts, new pages, new features, new integrations, major design changes, new content requests, or expanded deliverables may be billed separately.
✓ Client approvals may be treated as final approval for that stage, allowing the project to move forward.
✓ Changes requested after final approval, launch, delivery, or handover may be treated as new work or support work.

For promotional offers that include “unlimited revisions,” revisions are limited to reasonable changes within the agreed website scope, active support period, and original project direction. They do not include unlimited redesigns, new features, new pages outside scope, or strategic changes unless expressly stated.

6. Timelines, delays, and project pauses

Project timelines are estimates unless expressly stated otherwise. Timelines depend on client responsiveness, approvals, content readiness, technical access, third-party platforms, project complexity, and other factors.

✓ Delays in feedback, approvals, content, payment, credentials, or access may extend the project timeline.
✓ If a project is paused due to client delay, Mesh & Myth may revise the delivery schedule when the project resumes.
✓ If a project remains inactive for an extended period, we may require a restart fee, revised scope, or updated proposal before resuming.
✓ We are not responsible for delays caused by third-party platforms, domain registrars, hosting providers, payment gateways, email providers, CMS tools, or other external services.

7. Fees, payments, taxes, and non-payment

Fees are stated in the applicable proposal, invoice, package, agreement, or statement of work. Unless otherwise stated, payments are due according to the invoice or approved payment schedule.

✓ All fees must be paid in full according to the agreed payment terms.
✓ Deposits, milestone payments, retainers, and subscription payments may be required before work begins or continues.
✓ Fees are exclusive of applicable taxes, duties, bank fees, currency conversion charges, gateway fees, and third-party costs unless stated otherwise.
✓ Late or failed payments may result in paused work, withheld deliverables, suspension of services, or service disruption.
✓ Payments already made may be non-refundable once work has started, resources have been allocated, or deliverables have been prepared, unless otherwise required by law or agreed in writing.

8. Managed Digital Infrastructure

Managed Digital Infrastructure may include domain support, DNS management, hosting setup and maintenance, SSL setup, corporate email configuration, CDN and performance optimization, backups, uptime monitoring, traffic monitoring, monthly reports, and related operational support.

✓ Managed Digital Infrastructure is available only for websites designed and developed by Mesh & Myth unless we agree otherwise in writing.
✓ Infrastructure fees may be billed monthly or annually according to the selected plan or offer terms.
✓ Invoices may be raised on the 1st of every month where monthly billing applies, and late payment may cause service disruption.
✓ Additional email accounts, migrations, integrations, platform fees, premium plugins, themes, licenses, tools, hosting upgrades, or third-party costs may be charged separately.
✓ Clients remain responsible for maintaining accurate ownership, renewal, billing, and access information for domains, email, hosting, and third-party accounts unless expressly managed by Mesh & Myth.

9. Third-party platforms, tools, and services

Our services may involve third-party platforms, tools, providers, plugins, APIs, hosting services, CMS platforms, analytics tools, email providers, domain registrars, payment systems, CRM tools, and other external services.

✓ Third-party services are governed by their own terms, privacy policies, pricing, uptime commitments, and support limitations.
✓ We are not responsible for third-party outages, price changes, policy changes, security incidents, account restrictions, API changes, feature removals, or service discontinuation.
✓ You are responsible for complying with third-party terms where you own or operate the relevant account.
✓ Any third-party costs are separate unless expressly included in the proposal or infrastructure plan.

10. Intellectual property and ownership

Ownership of final deliverables transfers to the client only after full payment has been received, unless otherwise stated in a written agreement. Until payment is complete, Mesh & Myth retains ownership of concepts, drafts, working files, designs, code, strategy documents, and deliverables.

✓ You retain ownership of materials, trademarks, content, images, data, brand assets, and information you provide to us.
✓ Mesh & Myth retains ownership of pre-existing methods, processes, systems, templates, know-how, frameworks, internal tools, non-client-specific components, and reusable materials.
✓ Unused concepts, rejected designs, drafts, explorations, and alternate routes remain the property of Mesh & Myth unless purchased or assigned separately.
✓ You grant Mesh & Myth permission to use your materials solely as needed to perform the services.
✓ Unless restricted by written agreement, Mesh & Myth may display completed work in portfolios, case studies, proposals, social media, award submissions, and marketing materials.

11. Confidentiality

Each party may receive confidential information during a project or business relationship. Both parties agree to use reasonable care to protect confidential information and not disclose it except as necessary to perform the services, operate the business, comply with law, or with permission.

Confidential information does not include information that is publicly available, independently developed, already known without restriction, or received lawfully from another source.

12. Privacy and data handling

Personal information is handled according to our Privacy Policy. By using our website or services, you acknowledge that Mesh & Myth may collect and process information required for communication, proposals, billing, service delivery, support, analytics, and business operations.

If a project requires handling customer data, employee data, applicant data, patient data, sensitive information, or regulated data, you must inform us before the project begins so that appropriate scope, controls, and obligations can be reviewed.

13. Disclaimers, limitations, and indemnity

We aim to deliver thoughtful, high-quality work. However, we do not guarantee specific business results, revenue, rankings, traffic, leads, conversions, funding outcomes, investor responses, search engine placement, or uninterrupted third-party service availability.

✓ Services and website content are provided on a reasonable professional-efforts basis unless a specific written warranty is provided.
✓ To the maximum extent permitted by law, Mesh & Myth will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.
✓ Our total liability for a claim related to services is limited to the amount paid by the client for the specific service giving rise to the claim, unless applicable law requires otherwise.
✓ You agree to indemnify and hold Mesh & Myth harmless from claims arising from materials you provide, unlawful use of deliverables, breach of these Terms, third-party rights infringement, or misuse of services.

14. Termination, suspension, and service disruption

Either party may terminate a project or service according to the relevant proposal, agreement, or applicable law. Mesh & Myth may pause, suspend, or terminate services if payment is overdue, access is not provided, communication is inactive, the client breaches these Terms, or continued work creates legal, operational, reputational, or safety concerns.

✓ Fees for completed work, active subscriptions, third-party costs, and allocated resources may remain payable after termination.
✓ Non-payment may result in paused work, withheld files, suspended infrastructure services, or disruption to managed services.
✓ Upon termination, client access, support, maintenance, reporting, hosting, email support, or other services may end unless otherwise agreed.

15. Governing law and disputes

These Terms should be governed by the jurisdiction stated in the applicable agreement, proposal, or invoice. If no jurisdiction is stated, the governing law and dispute venue should be confirmed by Mesh & Myth in the final legally reviewed version of these Terms.

Before starting formal proceedings, both parties agree to first attempt to resolve disputes in good faith through written communication and reasonable discussion.
Legal counsel should insert the final governing law, venue, dispute process, and any required regional consumer or business law language before publication.
